Orissa High Court Blocks Political Interference in Teachers’ Transfers

The Orissa High Court on Thursday (November 27, 2025) quashed a State government directive that allowed Members of Parliament (MPs) and Members of Legislative Assembly (MLAs) to recommend the transfer of school teachers. The Court declared the order unconstitutional and harmful to the integrity of the education system.

Justice Dixit Krishna Shripad, delivering the judgment, observed that teachers are frequently deployed for election duties during parliamentary and assembly polls. Allowing political representatives to influence their transfer, he said, could lead to an unhealthy political nexus.

He remarked, “In a vibrant democracy like ours, elections are celebrated like festivals. Teachers play a vital role during election preparations. An order enabling MPs/MLAs to recommend transfers has the potential to create an undesirable connection between political parties and the teaching community.”

The Court warned that such interference could produce the “fruits of a poisonous tree” by building political pressure on teachers, especially those who shape young students at the foundational level up to Class X. Teachers, it stressed, must maintain distance from political involvement to preserve the quality and neutrality of education.

Dismissing the State’s claim that the notification was merely recommendatory, the Court noted that even non-binding recommendations could lead to undue influence and misuse of power.

The High Court ordered that teachers who were transferred on the basis of political recommendations will continue in their present schools till the end of the academic year. “Even if the transfer orders are set aside, those who have already joined new posts should continue till the academic year ends, so students do not suffer,” the judgment stated.

The ruling is seen as a major step towards protecting the independence of teachers and preventing political interference in the education system.
