Admissibility of Leave Salary (Exclusion of Special Pay)
Doubts were raised in certain quarters whether 'Special Pay' (allowed for arduous duties or specific additions to work/responsibility) will be included towards 'Pay' for the purpose of calculating leave salary on unutilised Earned Leave.
Clarification:
It is hereby clarified that Special Pay will NOT be taken into account while calculating the leave salary on unutilised earned leave.
The 'Pay' for this purpose includes:
- Basic pay as defined in Rule 33(a)(1) of O.S.C. (received immediately before retirement/death).
- Personal Pay, granted under Rule 37(a) of O.S.C.
- Any other recurring emoluments which may be specially classed as "Pay" by Govt. U/R-33(a)(iii) of O.S.C.
