Key Provisions of the Amendment Rules

  • Short Title: These rules may be called the Central Civil Services (Leave) Himachal Pradesh Amendment Rules, 2026.
  • Commencement: They shall be deemed to have come into force with effect from 7th August, 2024.
  • Substitution of Rule 56: Rule 56 of the Central Civil Services (Leave) Rules, 1972, in their application to the State of Himachal Pradesh, has been substituted.
  • Study Leave Outside India: During Study Leave availed of outside India, a Government servant shall draw Leave Salary equal to the pay drawn while on duty immediately before proceeding on such leave, plus Dearness Allowance and House Rent Allowance.
  • Study Leave in India: During Study Leave availed of in India, a Government servant shall draw Leave Salary equal to the pay drawn while on duty immediately before proceeding on such leave, plus Dearness Allowance and House Rent Allowance as admissible under Rule 60.
  • Condition for Full Leave Salary: Payment of leave salary at full rate is subject to furnishing of a certificate by the Government servant to the effect that he is not in receipt of any scholarship, stipend, or remuneration in respect of any part-time employment.
  • Adjustment of Scholarship/Stipend: Any amount received as scholarship, stipend, or remuneration during the period of Study Leave shall be adjusted against the Leave Salary, subject to the condition that the Leave Salary shall not be reduced to an amount less than that payable during half-pay leave.

  • Full Salary on Study Leave: Government servants can now draw full pay, DA, and HRA during Study Leave both in India and abroad.
  • Retrospective Effect: The rules are deemed to have come into force from 7th August, 2024.
  • No Scholarship/Stipend: Full leave salary is subject to the condition that the employee is not receiving any scholarship, stipend, or remuneration.
  • Adjustment Provision: If any scholarship/stipend is received, it will be adjusted against the leave salary, but the leave salary cannot be reduced below the half-pay leave salary amount.
  • Legal Authority: The rules have been framed in exercise of powers conferred by the proviso to Article 309 of the Constitution of India.
  • Consultation: The rules have been made in consultation with the Himachal Pradesh Public Service Commission.
  • Applicability: These rules apply to the Central Civil Services (Leave) Rules, 1972, in their application to the State of Himachal Pradesh.
