Key Provisions of the OM
- Applicability: Rule 25 of the CCS (Pension) Rules, 2021 applies to a Government servant who was dismissed, removed, or compulsorily retired from service and is subsequently reinstated on appeal or review.
- Counting of Past Service: Such a Government servant is entitled to count his past service as qualifying service.
- Interruption Period: The period of interruption in service between the date of dismissal/removal/compulsory retirement and the date of reinstatement shall NOT count as qualifying service.
- Exception to Interruption: The interruption period (and any period of suspension) may be counted as qualifying service only if regularized as duty or leave by a specific order of the authority which passed the reinstatement order.
- Implementation: All Ministries/Departments are requested to bring these provisions to the notice of personnel dealing with pensionary benefits for strict implementation.
What This Means for Reinstated Employees
- Past Service Counts: If you were dismissed, removed, or compulsorily retired and later reinstated on appeal or review, your past service before dismissal counts as qualifying service for pension purposes.
- Interruption Period Not Counted: The time between your dismissal and reinstatement does NOT count as qualifying service unless specifically regularized as duty or leave by the reinstating authority.
- Specific Order Required: To count the interruption period as qualifying service, a specific order from the authority that passed the reinstatement order is mandatory.
- Pension Calculation: This clarification ensures that reinstated employees get the correct pensionary benefits based on their total qualifying service, minus the unregularized interruption period.
- Strict Implementation: Ministries and Departments are directed to implement these provisions strictly for all pension-related cases.
